Defense Verdict / Pedestrian Claims She was Struck by Reversing Vehicle

Attorney Colleen Garlick successfully achieved a defense verdict after a 2-day trial in New London Superior Court.

The plaintiff claimed that the defendant backed into her with his motor vehicle in a parking lot while she was standing in said parking lot. The plaintiff alleges that this incident caused her significant lumbar strain, back pain, and bilateral arm and leg weakness and pain that altered her quality of life.

Attorney Garlick argued that the accident did not occur as alleged by the plaintiff.  The plaintiff claimed that she entered the parking lot to check a license plate for her Uber, realized it was not her ride, and remained there to check the Uber app.  The plaintiff was on her phone with her back to the defendant’s vehicle when she claimed that he backed into her.  It was argued that she did not see the vehicle back up and did not hear any noise or music coming from the vehicle.  The defendant, and his son, who was present in the vehicle at the time and testified, maintained that the vehicle was in park while the plaintiff was near the vehicle and that he safely backed up and left after she walked away.

After deliberation, the jury issued a defense verdict in favor of the defendant motor vehicle operator.
